Samsung has filed a plea asking the supreme court to consider its case of infringement of the patents that, according to apple, caused heavy loss to the iPhone maker. On the other side, the Cupertino based tech company isn’t impressed. It had to fight court battles for really long time and thinks it time to stop.
Accordingly, apple has filed a counter asking the supreme court to not consider the case as it was “legally unexceptional”. It thinks that the case has reached its legal end.
“Samsung had its day in court — many days, in fact — and the properly instructed jury was well justified in finding that Samsung copied Apple’s designs and should pay the damages that the statute expressly authorizes,” Apple’s filing said.
Ssmasung had paid apple around $600 million for its infringed patents in December last year. The court battle has been going on for 4 years now.
If the court decides to take up the case, it could go on for some more time as there would be enquiry into the infringements and patent design from the scratch. Samsung has argued in the past that the patent system should be removed as it is very discouraging for the smaller tech companies to introduce new products due to the fear of costly patent battle with the reigning tech titans which they cannot afford and in this quest, Samsung has the backing of powerful organizations like google, Facebook and dell.
Samsung released a statement in light of apple’s counter.
“If the legal precedent in this case stands, innovation could be diminished, competition could be stifled and opportunistic lawsuits could have negative effects throughout the US economy,” the company said.
